On Tuesday, Tamil Nadu Chief Minister MK Stalin refused to accept the Citizen Amendment Act (CAA) as ” divisive and bereft of any use” and asserted that he won’t allow its implementation in the state. He reiterates that CAA goes against the concepts of pluralism, secularism, minority communities, and the Sri Lankan Tamil refugees.
Stalin, also president of the ruling DMK terminated the CAA as anti-constitutional.
He says,”CAA is wholly unnecessary and should be repealed. We will not in any way permit the law to be enforced in Tamil Nadu. I make it clear to the people of Tamil Nadu that state government will not give place to any law that will affect India’s unity,” he made his action further clear.

He accused BJP as the Centre for “hurriedly” issuing the notification to enforce the law so close to the General Elections, despite the opposition’s refusal. As per the Stalin , the CAA and its rules went against the basic structure of constitution.
The Tamil Nadu CM says that there won’t be any use or benefits due to the CAA. It would only pave way for creating divisions among the Indian people.
The stand of the state government is that this law is completely unwarranted; it is one that must be repealed.
This is how he has made his decision and announced that Tamil Nadu government will not give any opportunity in any manner to implement the CAA in his state, he said as a part of official release.
His point of view further explains that CAA not only goes against the fundamental principles of the Constitution but also the nation’s pluralistic and secular character also well being of people who co -exist in peace and harmony despite of having all kinds of cultural barrier like language, ethnicity and religious differences.
Stalin moreover raised an important concern after he said, “It is also against the welfare of minorities and Sri Lankan Tamil refugees living in camps,” he said.
Can the state govt. stop the implementaion?
CM Stalin had “no powers” under law of the land to say he would not implement the Citizenship Amendment Act (CAA), said Cm’s opposition BJP state president K Annamalai on Tuesday.
He further added that no Muslim would be denied of their citizenship right.
Outlining constitutional provisions such as state list, Union list and concurrent list and separation of powers including those related to legislation, the BJP leader said to the CM that he (Stalin) has taken his oath of office under the constitution.
Though Stalin may oppose CAA politically but he is bound to it and can not take an official stand against implementing it in Tamil Nadu, says Annamalai.
Additionally, he also told the reporters that the CAA is well-reasoned and grant citizenship to persecuted minorities and not a single citizenship could be cancelled under this act.
As for the Sri Lankan Tamils, they have also been granted citizenship according to extant rules.
“CAA is to provide citizenship and not to cancel the already existing citizenship. Actually, there is no word in the Act that says Muslims in the country will be exempted from their citizenship in any manner.”
This uproar follows after the Union government rolled out rules on Monday for implementing after four years of passing the bill. Since the moment the CAA rules were announced, it received a strong backslash from its opposition parties.
The Parties in Tamil Nadu condemned the CAA by saying that it had excluded Sri Lankan Tamils from the Act, which is again the opposition’s perspective but from BJP’s point of view and statements, its not true.
BJP clarifies that the Sri Lankan Tamil refugees in Tamil Nadu were concerned, the Indian government has been following the principle of non-refoulment, which prohibits sending people back to a place where their life and safety is in danger, and even those who are eligible were given citizenship.
